Ohio Building Owner Illegally Disposed of Asbestos Products

A federal jury has indicted a building company and its owner on charges of improper asbestos abatement after products containing the dangerous fiber were found illegally disposed of.

Asbestos Lawsuit: According to the Lorain Chronicle-Telegram, Lorne J. Elbert Jr. and his company – Elbert Building Co. Inc. – were indicted on EPA charges of illegally removing asbestos from the city’s former Builders Square building that the company owns.

After contacting a licensed asbestos abatement company in June 2007 to inquire on pricing for the removal of 800 square feet of asbestos insulation from the building’s boiler room before it was demolished, Elbert Building Co. received a $4,900 quote for the work to be performed, according to the indictment. While Elbert informed the Ohio Environmental Protection Agency that it would be using a licensed asbestos contractor for the project, it instead paid an unlicensed individual $35 to do the work one month later.

Mesothelioma Information: During an inspection by the Ohio EPA that followed the work, inspectors found four drums that contained dry asbestos products, while asbestos particles were also found left behind on the boiler room and in the parking lot, according to the indictment.

Remembering Steve Mcqueen Beloved Actor and Mesothelioma Victim

Steve McQueen was one of the most cherished actors of the 20th century, appearing in such classic films as The Magnificent Seven, Bullitt, and The Thomas Crown Affair. His anti-hero persona allowed him to play challenging roles that most actors were not capable of undertaking. He remains a legend of American cinema.

Asbestos Lawsuit: This March 24 would havemarked McQueen’s 82nd birthday. But sadly, McQueen died of complications from the deadly asbestos-related cancer mesothelioma in 1980 when he was just 50-years-old.

Mesothelioma can affect people from all walks of life, and McQueen was an example of that. While some people are diagnosed with the disease know how they were exposed to asbestos fibers, others have never had noticeable contact with the substance. Shipbuilders, miners and construction workers tend to have higher frequency of mesothelioma exposure because their jobs often required them to come in contact with asbestos materials.

On the other hand, McQueen – who was an actor and stunt man for much of his professional life – did not have as clear a history of prolonged asbestos exposure.

As we remember Steve McQueen’s remarkable career and tragic death, we should also remember the deadly legacy that asbestos carries with it. For much of his life, McQueen could have encountered asbestos materials in building materials, car parts, cleaning supplies, fabrics, cigarette filters, and countless other products.

McQueen once said, “I don’t believe in that phony hero stuff.” He is, however, a hero to many for the way he took on on mesothelioma and tried to fight the disease that has has claimed the lives of so many, and eventually took his. When McQueen died, he was in Mexico still seeking treatments for his disease that American doctors warned could be fatal.

School Closed Following Discovery of Asbestos

A school in the UK has been evacuated following the discovery of asbestos products during renovation work that was being performed at the facility.

Asbestos: According to the BBC, Flora Stevenson Primary School in Edinburgh was evacuated and closed for the week after work being done to the school building disturbed asbestos after a worker drilled through a board in the school’s cloakroom.

Disturbing the asbestos potentially made it easier for small fibers to get into the airstream where children and teachers could breathe them in. All 447 students and teachers were evaluated for asbestos exposure, and sent to a neighboring school to conduct the rest of their classes for the week.

Mesothelioma Help: This situation is yet another reminder that there are still a number of schools in the UK and the United States that still contain the original asbestos products they were constructed with. Remembering Terry McCann Wrestler and Victim of Asbestos

Terrence McCann might not be a name that you immediately recognize, but in the late 1950s and early 1960s his dominance on the wrestling mat was legendary.

As a competitor for the University of Iowa, he won two Big Ten titles and two national championships. He eventually went on to win a gold medal for the United States in the 1960 Summer Olympics in Rome, Italy. He was inducted into the National Wrestling Hall of Fame in 1977. He is truly a legend in the sport of wrestling.

Mesothelioma Lawsuits: McCann would have turned 78 on this March 23, but he was a victim of the deadly cancer mesothelioma, which is caused by asbestos fibers. He died in 2006 of complications from the disease, which has claimed the lives of tens of thousands of people around the world.

McCann believed he was exposed to the asbestos that caused his death while briefly working for an oil refinery in Oklahoma as a youngster. He contended that a boiler at the plant used asbestos as insulation.

Asbestos exposure of any length can cause a wide range of medical complications, most notably mesothelioma and asbestosis.

The United States took home three gold medals for freestyle wrestling in Rome, including McCann’s win in the bantamweight class. It was an Olympiad that highlighted the intense athletic rivalry between the United States and Soviet Union. McCann came home from the games an American hero. Later in life, Terry McCann spent much of his time taking on the powerful organizations that had been the root of several different health issues in his life, including his asbestos-related disease.

Talc In Cosmetics May Contain Asbestos

The FDA has conducted an exploratory survey of cosmetic products that contain talc and cosmetic-grade raw material talc due to concerns the products may contain asbestos.

According to the FDA, no asbestos fibers were found in any of the samples. However, the results were somewhat limited because the FDA only received talc from four suppliers. The survey concluded that the results were informative but do not prove that all cosmetics containing talc sold in the U.S. are asbestos free.

Asbestos Exposure: Talc is a mineral that occurs naturally and is composed of silicon, hydrogen, oxygen, and magnesium. Scientific literature that dates back to the 1960s has suggested talc may be linked to ovarian cancer.

UK Carriagework Asbestos Deaths Tops 140

Asbestos Settlements: The total number of UK carriagework employees from York who have passed away from asbestos-related diseases such as mesothelioma has now topped 140, and the true number of deaths may be much higher.

According to the York Press, Arnie “Tivvy” Gomersall worked as a coachbuilder in York factories for years, continually exposing himself to asbestos in the process. Following Gomersall’s recent passing due to mesothelioma, Paul Cooper – a carriageworks trade union official – said that he was the 141st carriageworks employee to pass away from an asbestos related disease.

While that number may seem high, Cooper warned that the true number of deaths attributed to asbestos exposure was likely much higher, as that figure only showed the number of people who had died from mesothelioma and been investigated by inquests in York.

“[The number] excludes people whose mesothelioma may not have been picked up by doctors, which does happen sometimes,” Cooper said. “There will also be others who moved away from York years ago, or who died while being treated in hospitals elsewhere.”

Asbestos Cancer: The dangers of asbestos are not limited only to UK carriageworks factories, and are experienced by those who worked in U.S. factories during much of the 20th century as well. If you have been exposed to asbestos and now suffer from mesothelioma, call Sokolove Law to learn more about potentially pursuing a mesothelioma lawsuit.

UN Headquarters Undergoing Asbestos Abatement

Like many older buildings, the United Nations headquarters in New York City still contains potentially dangerous asbestos products that are only now being removed as part of a $2 billion renovation project.

Asbestos Cancer: According to the Associated Press, the UN headquarters is currently undergoing its first major renovation in its 60-year history ago. While many of the renovations are intended to increase the building’s security and safety in the event of a terrorist attack, asbestos abatement is a project that is being undertaken as well.

The abatement process has not been without its missteps, some of which may have put UN employees at an increased risk of developing illnesses such as asbestosis or mesothelioma. Some asbestos abatement work in the building began before U.N. staff were able to move from their offices to a temporary work location. The mistake led to accusations by the U.S Staff Union that the workers had been lied to about their safety during the construction.

Any level of asbestos exposure can be dangerous and increase the odds of developing an asbestos-related illness later in life.

If you have been exposed to dangerous levels of asbestos and now have mesothelioma, contact Sokolove Law today to learn more about possible pursuing a mesothelioma claim.

Yoga Therapy Helps Cerebral Palsy Patient

Twenty-year-old Erin Feeney was born with cerebral palsy that affects both her muscle use and speech. However, through the use of yoga programs designed for people with special needs, she has been able manage the effects of her condition.

The Chicago Tribune recently reported on Feeney, who has performed specialized yoga for one hour a week over the last three years with practitioner Karen Fakroddin. The yoga therapy usually consists Feeney having her extremities gently manipulated and stretched while also using her neck muscles to lift her head.

Birth Injury Attorney: In the time since beginning her yoga therapy, Feeney has seen dramatic improvement in her trunk control, stamina, breathing, and digestion while also decreasing the amount of pain she used to feel in her limbs.

“The knowledge of yoga for special needs is up, and there is more coming,” said Fakroddin. “It helps the special needs children to slow down, to focus. They are able to accept their limitations and work through them. It’s a tough world. To be able to empower them, to give them the tools to help themselves, is wonderful.”

While a treatment program such as yoga for people with special needs usually requires a doctor’s approval, that does not mean that an insurance company will necessarily pay for the costs associated with it.

Cerebral Palsy Malpractice: If you have a child who was born with cerebral palsy and requires treatment that insurance won’t cover, speak to Sokolove Law today about pursuing a birth injury lawsuit. Money won in a lawsuit can be directed specifically towards medical bills for the rest of your child’s life.

Chilling Asbestos Poster Focuses On the World Trade Center

“When life depends on it, you use asbestos” is the ironic tag line on a 1981 poster advertisement touting the use of asbestos in the World Trade Center in New York. Long before terrorism represented a global threat, asbestos posed a serious danger to people who lived and worked in structures that used the toxic substance as a building material. The poster puts a high value on asbestos’ ability to reduce fire danger. It reads, “Asbestos contains fire, cannot burn and holds after metal and glass have melted down, giving vital time for people to escape.”

Mesothelioma Help: However, one of the most dangerous legacies of the terror attacks of September 11, 2001, stems from the large amount of asbestos particles that infested the New York City air for several weeks following the disaster. The collapse of the building exposed thousands to a substance that is known to cause aggressive cancers such as mesothelioma, and now there is an emerging health crisis given this link between asbestos and 9/11.

It remains to be seen whether or not the collapse of the twin towers will eventually be known as one of the greatest asbestos-related disasters in history. We still don’t know how badly residents, first responders and clean-up crews were infected by the toxic dust in the air. The effects of asbestos exposure can take more than 50 years to fully appear. Like many substances we now know to be hazardous, asbestos was once heralded as a miracle substance that would revolutionize construction. Looking back through history, advertisements for things like tobacco, lead-based paint, certain medications and asbestos look ridiculous given all that we know today about the health risks associated with these materials.

According to the World Trade Center advertisement, “We couldn’t live the way we do without [asbestos].” Of course, we now know that it is possible to live without asbestos. In fact, it’s the right thing to do. Asbestos is still legal here in the United States, despite the overwhelming evidence that there is no safe level of exposure to it.

Asbestos Attorney: Many substances have been banned because of health risks. Isn’t it time asbestos is added to that list? We shouldn’t see posters like this one anymore. Join us; help us ban asbestos now.
